Ce Code rassemble la législation relative à la protection de la vie privée à l'égard des traitements de données à caractère personnel, tant sur le plan supranational et national (fédéral) que sur le plan des Communautés et des Régions.

Avec l'entrée en application du Règlement général sur la protection des données (GDPR/RGPD) le 25 mai 2018, un basculement important a été accompli en droit européen et dans la foulée aussi en droit belge en matière de vie privée et de protection des données. C'est le résultat d'un exercice de grande envergure visant à moderniser et à préparer pour les défis du 21e siècle les principes et les règles qui avaient été à l'époque repris pour la première fois de façon systématique dans la Convention 108 du Conseil de l'Europe du 28 janvier 1981.

Cette nouvelle réglementation appelle un nouveau code, que voici.

Le droit relatif à la vie privée et à la protection des données est présent là où des personnes vivent et communiquent, intentionnellement ou pas, parfois volontairement, parfois par obligation... ou là où existe le droit. Ce droit est une oeuvre humaine - pour tous ceux pour qui, par qui il est écrit et expérimenté, subi et pratiqué. Si le droit relatif à la vie privée peut offrir davantage d'autonomie, générer une plus grande de liberté et assurer l'émancipation, il s'agit alors de bien plus qu'un exercice instrumental dans la pure technique du traitement de données.

Le présent code ne pourra convaincre personne qu'il existe une législation libératrice. Mais il est réconfortant de savoir que l'on oeuvre encore à la liberté.
