The EU, the WTO and China: Legal Pluralism and International Trade Regulation

In his famous 1956 Storrs lectures at Yale Law School, Philip Jessup defined ?transnational law' as including ?all law which regulates actions or events that transcend national frontiers'. Since then, however, globalisation, European integration, global legal pluralism, the creation of the World Trade Organization (WTO), and the rise of China and the other BRICS have profoundly altered the legal landscape. What is the future of transnational law? What does ?transnational law' mean in an age marked by global legal pluralism and the emergence of new sites of governance?

Is all law today ?transnational'? How does transnational law relate to regional, national and local cultures and traditions? Is transnational law limited to major players on the international stage, such as the European Union (EU), the United States and China? To what extent does it reflect the rise of the BRICS?

This bilingual volume comprises a selection of the revised versions of papers first presented at the 9th International Workshop for Young Scholars (WISH) / 9e Rencontre Internationale des Jeunes Chercheurs (RIJC). WISH/RIJC is an annual conference which seeks to bring together the most promising young scholars in specific fields of European Union law from universities of the EU Member States, and other countries in Europe, North and South America, the Middle East, Africa or Asia, including the United States, Canada, and China. Its objective is to identify and discuss themes which are likely to be the most significant topics of research in the field of European Union law in the first half of the 21st century. The 9th WISH/RIJC was held at Peking University School of Transnational Law (STL), Peking University Shenzhen Graduate School, China, from 29 November to 1 December 2012. It was the first WISH/RIJC in China. It was organised by the European Law Journal (ELJ), the Centre for Research on Transnational Law (CTL) at Peking University STL and the College of Europe in Bruges, Belgium, in cooperation with the Centre de Recherches Internationales et Communautaires (CERIC), Aix-Marseille Université, France. It discussed approaches to transnational law; transnational law and human rights; legal pluralism and risk regulation: food and environment; public and private actors in transnational regulation; judges, experts and lawyers in the making of transnational law; and regionalism and transnationalism.

L'avenir du droit transnational ; the future of transnational law

La protection des intérêts du citoyen constitue un défi majeur pour l'Union européenne. A l'heure de l'élargissement, il est essentiel d'orienter l'Union européenne vers les citoyens, non seulement en termes d'intégration économique mais aussi en termes de légitimité politique, de solidarité sociale et d'une véritable citoyenneté. Le progrès, à ces différents niveaux, passe essentiellement par une plus grande prise en compte et une protection accrue des intérêts du citoyen, surtout en matière de consommation, d'environnement et d'accès à la justice. Les grandes questions de l'actualité européenne forment le sujet des travaux de recherche publiés dans ce livre. Le thème du citoyen en tant que consommateur est approfondi par des analyses du développement d'un droit européen des contrats, du rapport entre protection des intérêts du citoyen et politique communautaire de libéralisation économique, de citoyenneté et accès aux services d'intérêt général, d'indemnisation du dommage causé par des médicaments défectueux, de protection des consommateurs et commerce électronique, de la juridiction pour les contrats conclus par l'Internet et de l'utilisation des directives communautaires pour harmoniser le droit privé. Le thème des intérêts du citoyen dans le domaine de l'environnement est abordé dans des analyses visant l'élaboration d'une définition communautaire du développement durable et la transposition de la Directive communautaire sur le droit d'accès à l'information concernant l'environnement en droit anglais et français. Le troisième thème, celui du citoyen et l'accès à la justice, fait l'objet des analyses sur l'émergence d'un concept communautaire de loi de police et sur la protection provisoire dans le contentieux administratif en Europe. Ce volume bilingue contient une partie des travaux scientifiques dont une version préliminaire a été présentée lors de la Première Rencontre Internationale des jeunes Chercheurs (RIJC) / Firsi International Workshop for Young Scholars (WISH) sur le thème Etudes juridiques européennes au 21ème siècle / European Legal Studies in the 21st Century, organisée à Aix-en-Provence les 20 et 21 septembre 2002 par le Centre d'Etudes et de Recherches Internationales et Communautaires (CERIC-CNRS-UMR 6108) de la faculté de Droit et de Science Politique de l'Université d'Aix-Marseille III et la Revue " European Law journal ". Cette Rencontre, une des premières organisées en Europe, avait pour mission de réunir l'ensemble des jeunes chercheurs les plus prometteurs dans le champ du droit européen des universités des États membres de l'Union européenne, des pays candidats et des autres pays comme la Chine ou les États-Unis pour débattre sur des thèmes pressentis comme les plus importants pour la recherche en droit européen au 21ème siècle. Ce volumc en est un des premiers fruits.

Comment protéger les intérêts du citoyen dans l'Union européenne aujourd'hui ? - Première rencontre internationale des jeunes chercheurs (RIJC)

During the part decade the European Union has developed the foundations of a common ration policy by harmomising national immigration and asylum laws and introducing new instruments. Despite some remarkable achievements European policy-makers have struggled to build a conceptual basis for migration policy. The Stockholm Program on the future of the Area of Freedom, Security and Justice underlines the need for continued critical reflection about the conceptual foundations and legal challenges of European migration law. This collection of essays by young and promising European lawyers from different national and academic backgrounds supports an interdisciplinary approach to the analysis of European migration law, reflecting the political, econornic and sociological context of legal rules governing the international movement of people. Since European migration law is a relatively new area of European law-making, young scholars are in a particularly good position to enhance our understanding of recent developments in and future challenges of the construction of European migration law. The European Union (EU) today is the result of a gradual process of deepening and widening. The EU enlargement of 1 May 2004 to include ten new Member States was however unprecedented in scale and of a different order. It posed - and continues to pose - new challenges to the countries which already belonged to the EU, to the new Member States and to the EU itself, as well as to third countries. It is among the main factors which define the new Europe. These significant issues form the subject of this book. The first part of the book concerns the impact of the 2004 enlargement on existing EU policies. The second part is devoted to the impact of EU policies on the new Member States. The third part of the book considers the management of the EU's new borders. The- European Courts - both the Court of Justice and the Court of First Instance - are central actors in the development of the European Union.
